Nicola Heim | artist
1. Scope
These Terms of Participation and Use apply to all in-person workshops, live online workshops, and recorded online courses (on-demand courses) offered by Nicola Heim.
The General Terms and Conditions of the online shop and statutory consumer rights also apply.
2. Registration, Booking, and Payment
Registration for workshops and online courses can be completed via the online shop or by individual arrangement by email.
For bookings made via the online shop, payment is made using the payment methods offered there.
For registrations by email, payment information and the Terms of Participation and Use will be provided before the contract is concluded. In this case, payment is made by bank transfer or PayPal.
A workshop place is only bindingly reserved once the full participation fee has been received.
Until payment is received, there is no entitlement to a reserved place.
The respective participation fees, dates, venues, and services are set out in the corresponding workshop or course description.
3. Withdrawal and Cancellation by Participants
After the expiry of any applicable statutory right of withdrawal, the following cancellation terms apply to in-person workshops:
-
Up to 28 days before the start of the workshop: Refund of the participation fee minus an administration fee of €50.
-
27 to 14 days before the start of the workshop: Refund of 50% of the participation fee.
-
From 13 days before the start of the workshop: If a cancellation is made 13 days or less before the start of the workshop, or if the participant fails to attend, the full participation fee will be due. Statutory rights remain unaffected.
A substitute participant may be designated at any time. The relevant contact details must be provided before the start of the workshop.
Statutory rights of withdrawal, cancellation, and other mandatory consumer rights remain unaffected.
4. Cancellation or Change by the Organizer
If a workshop cannot take place for organizational reasons, due to the instructor's illness, or due to unforeseen circumstances, already paid participation fees will be refunded in full.
If possible, an alternative date may be offered. Participation in an alternative date is voluntary.
Further statutory claims remain unaffected.
5. Live Online Workshops
Live online workshops are generally conducted via Zoom.
The access details will be sent by email in good time before the start of the course.
Participants are responsible for having suitable technical equipment and a stable internet connection.
If a recording of the workshop is offered, it will be available for the period specified in the course description.
The recording is intended exclusively for personal use. Distribution, publication, or commercial use is not permitted.
The terms for withdrawal and cancellation of live online workshops, as well as statutory rights of withdrawal, are subject to the applicable statutory provisions and the contractual terms provided before booking.
6. On-Demand Courses
On-demand courses are recorded online courses that are made available digitally independently of a fixed event date.
The scope of the course content, the materials included, and the duration of access are set out in the respective product description.
The provided content is intended exclusively for personal use.
Statutory provisions on withdrawal apply to digital content. The right of withdrawal may only expire at the start of provision before the expiry of the withdrawal period under the conditions provided by law.
7. Copyright and Usage Rights
All drawings, templates, templates, workbooks, course materials, videos, recordings, and other artistic materials created by Nicola Heim and protected by copyright remain the intellectual property of Nicola Heim.
By booking a workshop or course, participants receive a simple, non-transferable right of use for personal, non-commercial purposes, unless expressly agreed otherwise.
In particular, the following is not permitted without prior express permission:
-
Distributing, selling, or making templates, templates, workbooks, or course materials publicly available to third parties.
-
Using course materials, in whole or in part, for one's own commercial workshops, courses, or teaching offerings.
-
Reproducing, publishing, or making course videos or recordings available to other persons, unless expressly permitted.
-
Using copyright-protected artistic templates or teaching materials for commercial products or offerings.
-
Adopting specifically developed and provided teaching materials, presentations, instructions, or documented course procedures for one's own commercial course offerings, insofar as copyright or contractually agreed usage rights exist.
Participation in a workshop or online course does not entitle participants to commercially exploit the provided course materials or copyright-protected course content.
8. Participants' Own Artistic Works
In principle, participants may use, display, and publish artistic works they create themselves during a workshop or online course for their own personal and artistic purposes.
The use of works created during the workshop, photographs of these works, or documentation of the workshop to promote one's own commercial workshops, courses, or teaching offerings is only permitted with Nicola Heim's prior express consent, insofar as such a restriction can be legally agreed upon.
This applies in particular to promotional materials that contain protected templates or design elements by Nicola Heim, or that give a misleading impression of the origin, independence, or collaboration involved in the advertised course offerings.
Participants' rights to their independently created works, as well as permitted uses under statutory law, remain unaffected.
